These Terms & Conditions apply to purchases made through Artstac Gallery OÜ (“Artstac”, “we”, “us” or “our”) via our website and, where applicable, directly through the gallery.
By placing an order, you agree to these Terms & Conditions.

2. Artworks
Artstac offers original artworks and other art-related items as described on our website.
We make reasonable efforts to ensure that descriptions, dimensions, photographs and other information about each artwork are accurate.
Due to differences in screens, lighting and photography, colours displayed digitally may differ slightly from the physical artwork. Such minor variations do not constitute a defect.
Dimensions are stated as accurately as reasonably possible.
3. Availability
Unless otherwise stated, artworks displayed as available on our website are held in stock.
As original artworks are unique, an artwork can generally be sold only once. In the unlikely event that an artwork becomes unavailable after an order has been placed, we will contact you and refund any amount already paid for that artwork.
4. Prices
Prices displayed on our website are stated in euros unless otherwise indicated.
Any applicable taxes will be handled in accordance with applicable law.
Delivery, customs duties, import taxes or other charges may be additional unless expressly stated otherwise before purchase.
5. Orders and Payment
An order is considered accepted when Artstac confirms the order or otherwise accepts payment for the artwork.
Available payment methods are displayed during checkout.
We reserve the right to refuse or cancel an order in cases of an obvious pricing or technical error, suspected fraud, inability to fulfil the order, or other legitimate reason. If payment has already been received for a cancelled order, the relevant amount will be refunded.
6. Delivery
We deliver artworks to destinations indicated on our website or agreed individually with the buyer.
Delivery costs and estimated delivery times depend on the artwork’s dimensions, destination and delivery method.
Delivery times are estimates unless a specific delivery date has expressly been agreed.
International customers are responsible for any customs duties, import taxes or similar charges imposed by the destination country unless otherwise agreed.

7. Inspection Upon Delivery
Please inspect the artwork and its packaging promptly after delivery.
If an artwork arrives damaged, contact us as soon as possible at art@artstac.com and retain the artwork and all original packaging.
We may request photographs of the artwork, packaging and shipping label so that we can assess the damage and, where applicable, make a claim with the carrier.
8. Returns and Right of Withdrawal
Where you purchase online as a consumer and EU consumer protection legislation provides a statutory right of withdrawal, you may exercise that right within the applicable statutory period, subject to any exceptions permitted by law.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.
9. Authenticity and Documentation
Where an artwork is sold with a certificate of authenticity, provenance documentation or other accompanying documentation, this will be indicated where applicable and supplied with the artwork.
Any statements concerning attribution, provenance, date, artist or other characteristics are based on the information reasonably available to Artstac at the time of sale.
10. Copyright and Intellectual Property
Purchasing an artwork transfers ownership of the physical artwork to the buyer but does not automatically transfer copyright or other intellectual property rights relating to the artwork.
Unless otherwise agreed or permitted by law, copyright and reproduction rights remain with the artist or relevant rights holder.
Images, text, branding and other material appearing on the Artstac website may not be commercially reproduced or used without appropriate permission.
11. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by law, Artstac is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the contract was entered into.
12. Personal Data
Personal data is processed in accordance with our Privacy Policy.
13. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Estonia, without prejudice to any mandatory consumer protection rights that may apply to consumers residing in another jurisdiction.
Any disputes will be handled in accordance with applicable law.
